Having a POSH Policy Is Not the Same as Being POSH Compliant

Yes. The POSH Act applies to all organisations operating in India with 10 or more employees, regardless of whether the entity is Indian-owned or a foreign subsidiary. Foreign-owned companies are also often subject to additional scrutiny from parent company governance requirements and group audits.

Organisations must establish a compliant Internal Committee, maintain a valid POSH policy, conduct awareness programmes, manage complaints appropriately, and complete annual reporting requirements.

An internal committee under POSH that does not meet legal composition requirements is considered non-compliant. This includes missing external members, incorrect member composition, or expired terms.

The external member must be from an NGO or association committed to the cause of women, or a person familiar with issues relating to sexual harassment. They must not be an employee of the organisation. Their appointment is time-bound, typically three years and must be renewed.

The POSH annual report India records complaint statistics, actions taken, and compliance activities during the year. It must be submitted to the employer and the designated District Officer as required under the Act.
